Terms governing the software, integrations and systems provided by JKwek Holdings Ltd. through CK Applied Systems.

01 / Agreement

What these terms cover

These terms apply to software, integrations and systems built or operated by CK Applied Systems for a client, and to this website.

Where a separate written engagement agreement, statement of work or contract exists with a client, that agreement takes precedence over these terms wherever the two differ. These terms fill gaps; they do not override a signed contract.

02 / Use of the software

Permitted use

Software delivered under an engagement is for the client's own business use. Unless the engagement agreement says otherwise, it may not be resold, sublicensed or redistributed to third parties.

Clients are responsible for the accounts and credentials they connect, for who inside their business is given access, and for revoking access when a person no longer needs it.

03 / Client data

Ownership

Client data remains the client's property. Business records, financial data and anything reached through a connected system belong to the client, not to us.

We access it only to deliver the engagement. How it is handled is set out in the Privacy Policy.

04 / Third-party services

Connected platforms

Our software connects to services operated by others — including Intuit QuickBooks Online, Amazon, Shopify and inventory platforms. Those services are governed by their own terms and privacy policies, and the client's relationship with them is their own.

We do not control those services. Changes to their APIs, pricing, availability or terms may affect how an integration behaves, and are outside our control.

05 / Financial output

Reports and accounting records

Where our software produces financial reports or accounting entries, those outputs are a tool for the client and their advisors. They are not accounting, tax or legal advice.

Figures depend on the accuracy and completeness of the underlying source data. Clients remain responsible for reviewing output before relying on it, for their own filings, and for engaging a qualified accountant where appropriate.

06 / Warranty and liability

Limits

Except where an engagement agreement states otherwise, software is provided as is, without warranty of any kind, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.

To the extent permitted by law, our aggregate liability arising from the software or these terms is limited to the fees paid for the engagement in the twelve months preceding the claim. We are not liable for indirect, incidental or consequential loss, including lost profits or lost data.

Nothing here excludes liability that cannot lawfully be excluded.

07 / Termination

Ending an engagement

Either party may end an engagement in line with the engagement agreement. On termination, connected access is revoked and working copies of client data are deleted on request.

Clients may revoke any individual connection at any time, directly from the platform that granted it.
